Bienvenido a RumboYa. Antes de utilizar nuestra plataforma y aplicaciones, le pedimos que lea atentamente los siguientes Términos y Condiciones, los cuales constituyen un acuerdo legal vinculante entre usted ("el Usuario") y RumboYa SAC.

1. Uso Aceptable de la Plataforma

Al acceder o utilizar RumboYa, usted se compromete a hacer un uso adecuado y lícito de las herramientas tecnológicas provistas. Queda estrictamente prohibido, bajo penalidad de suspensión, suplantar la identidad de terceros o realizar acciones fraudulentas que comprometan la veracidad de la información en el sistema.

2. Plataforma como Solución Tecnológica y Límite de Responsabilidad

RumboYa es exclusivamente una plataforma tecnológica y de gestión integral para el transporte. No operamos rutas por cuenta propia ni somos propietarios de los vehículos, por ende no somos responsables de los tiempos de llegada, retrasos, la calidad del servicio brindado, ni accidentes de tránsito.

RumboYa declina explícitamente cualquier responsabilidad civil, penal o administrativa ante siniestros, extravíos en la ruta, o disputas y altercados directos que pudieran surgir entre el equipo de la Empresa, Pasajeros o Conductores.

3. Roles en el Sistema

RumboYa integra a diversos perfiles dentro de nuestro sistema, cada uno con distintas obligaciones y derechos:

Administrador/Empresa: Puede gestionar su propia flota y visualizar el estatus de sus agentes mediante la plataforma web institucional de RumboYa.
Conductores: Son responsables de mantener actualizados sus registros principales. La plataforma valida dichos datos y permite enlazarlos con las empresas de transporte que hacen uso de RumboYa.

4. Cuenta y Registro

Usted es responsable de resguardar su contraseña. RumboYa proporciona las herramientas integradas requeridas por Google Play Store para que pueda solicitar en cualquier momento la eliminación total y permanente de su cuenta y borrar su rastro digital de nuestras bases de datos cuando no desee utilizar más el servicio.

5. Comunicaciones y Notificaciones

Al registrarse y proporcionar su correo electrónico, usted acepta recibir correos electrónicos indispensables para la creación de cuenta y recuperación de contraseñas u otros cambios de perfil. Adicionalmente, podríamos usar alertas de notificaciones informativas vía la app móvil o el panel web.

6. Propiedad Intelectual

Todo el contenido visual, diseño UI, logotipos, las bases de datos en la nube, código y arquitectura detrás de RumboYa son propiedad exclusiva de RumboYa SAC y están protegidos por las leyes de propiedad intelectual y derechos de autor interacionales.

7. Modificaciones en el Servicio

Nos reservamos el derecho de suspender o cancelar su cuenta si sus acciones violan de cualquier modo el presente contrato. Asimismo, RumboYa podrá realizar revisiones sin previo aviso y si los términos aquí dictados cambian, el uso continuado de la plataforma constituye su aceptación total.

Welcome to RumboYa. Before using our platform and applications, please read carefully the following Terms and Conditions, which constitute a legally binding agreement between you ("the User") and RumboYa SAC.

1. Acceptable Use of the Platform

By accessing or using RumboYa, you agree to make proper and lawful use of the technological tools provided. Impersonating third parties or engaging in fraudulent actions that compromise the veracity of the information in the system is strictly prohibited under penalty of suspension.

2. Platform as a Technological Solution and Limit of Liability

RumboYa is exclusively an integrated technology management platform for transportation. We do not operate routes directly, nor do we own the vehicles, hence we are not responsible for arrival times, delays, on-board service quality, or traffic accidents.

RumboYa explicitly declines any civil, criminal, or administrative liability for accidents, loss of belongings, or direct disputes that may arise between the Fleet Company, Passengers, or Drivers.

3. System Roles

RumboYa integrates various profiles within our system, each with distinct obligations and rights:

Admin/Company: Can manage their own fleet and view the status of their agents through the institutional RumboYa web platform.
Drivers: Are responsible for keeping their primary records updated. The platform validates this data and lets them link with transportation companies using RumboYa.

4. Account and Registration

You are responsible for safeguarding your password. RumboYa provides the integrated tools required by the Google Play Store so you can request total and permanent deletion of your account at any time and erase your digital footprint from our databases.

5. Communications and Notifications

By providing your email address upon registration, you agree to receive essential account creation and profile update emails. We may additionally use informative notification alerts via the mobile app or web panel.

6. Intellectual Property

All visual content, UI design, logos, cloud databases, code, and architecture behind RumboYa are the exclusive property of RumboYa SAC and are protected by international intellectual property and copyright laws.

7. Service Modifications

We reserve the right to suspend or cancel your account if your actions violate this contract in any manner. Furthermore, RumboYa may perform revisions without prior notice, and if the terms here dictated change, continued use of the platform constitutes full acceptance.
